1. Agreement to Terms
By accessing or using RealtorFinder.net (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. These Terms constitute a legally binding agreement between you and RealtorFinder, LLC ("RealtorFinder," "we," "our," or "us").
2. Description of Service
RealtorFinder operates a reverse real estate marketplace that connects home sellers with licensed real estate agents nationwide. The Platform allows:
- Sellers to list their properties and receive competing proposals from licensed realtors
- Realtors to browse active listings and submit proposals to potential seller clients
- Buyers to post buyer requests and receive responses from buyer's agents
Important Disclaimer: RealtorFinder is a technology marketplace platform and is NOT a licensed real estate broker, agent, or brokerage. We do not provide real estate brokerage services, and nothing on this Platform constitutes real estate advice. All real estate transactions are conducted exclusively between users and their chosen licensed real estate professionals.
3. User Accounts
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password confidential and notify us immediately of any unauthorized use
- Be responsible for all activity that occurs under your account
- Not create accounts for others without their permission
- Not use another person's account without authorization
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or harmful activity.
4. Seller Terms
If you use the Platform as a home seller, you agree that:
- All property information you provide is accurate and not misleading
- You have the legal authority to list and sell the property
- You will not misrepresent the condition, value, or features of your property
- Listing your property on RealtorFinder does not obligate you to accept any proposal or sell your home
- RealtorFinder charges no fees to sellers for listing their property or accepting proposals
- You are responsible for independently verifying realtor credentials and conducting appropriate due diligence before engaging any agent
- RealtorFinder is not responsible for the performance, conduct, or results of any realtor you engage through the Platform
5. Realtor Terms
If you use the Platform as a licensed real estate agent or broker, you agree that:
- You hold a valid, active real estate license in good standing in the state(s) where you practice
- You will maintain your license in good standing throughout your use of the Platform
- All information you provide about your credentials, experience, and track record is accurate
- You will conduct all proposals and communications professionally and in compliance with applicable law, your state licensing board's code of ethics, and any applicable professional standards
- You will not engage in deceptive, misleading, or manipulative practices
- Monthly proposal limits apply based on your subscription tier (Basic: 5 proposals/month)
- Subscription fees, if applicable, are billed monthly and non-refundable except as required by law
- RealtorFinder reserves the right to verify your license and suspend access if license verification fails
- License Verification Process: Upon signup, you must provide your real estate license number. We will use publicly available state licensing databases to verify your license is active and in good standing within 1–3 business days. If verification cannot be confirmed, your account will be suspended pending manual review. You will be notified by email and given an opportunity to provide supporting documentation (e.g., license certificate) by replying to that email. If your license lapses or is revoked after activation, you must notify us immediately and your access will be suspended. To appeal a suspension, email legal@realtorfinder.net with supporting documentation; appeals are reviewed within 5 business days.
6. Buyer Terms
If you use the Platform as a home buyer, you agree that:
- Information you provide in buyer requests is accurate to the best of your knowledge
- You understand that RealtorFinder does not guarantee you will find a buyer's agent through the Platform
- Any relationship with a buyer's agent is solely between you and that agent
- As of August 2024, buyer's agent commissions are no longer automatically included in MLS seller offers. You must negotiate compensation directly with your buyer's agent and confirm all terms in a written buyer representation agreement before touring homes. RealtorFinder does not set, negotiate, or guarantee agent compensation.
7. Prohibited Uses
You agree not to use the Platform to:
- Violate any applicable law, regulation, or third-party rights
- Post false, misleading, or fraudulent listings or proposals
- Harass, abuse, threaten, or discriminate against any user
- Scrape, crawl, or systematically extract data from the Platform
- Circumvent, disable, or interfere with security features of the Platform
- Use the Platform to send unsolicited commercial communications (spam)
- Impersonate any person or entity
- Engage in any activity that disrupts or interferes with the Platform's infrastructure
- Collect or harvest personal information from other users without consent
8. Intellectual Property
The Platform and its original content, features, and functionality are owned by RealtorFinder, LLC and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
You retain ownership of any content you submit to the Platform (such as listing details and photos), but by submitting it, you grant RealtorFinder a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute that content in connection with operating and improving the Platform.
9. Third-Party Services
The Platform integrates with third-party services including but not limited to Stripe (payments), SendGrid (email), Cloudinary (image hosting), Google Analytics, and Microsoft Clarity. Your use of these services is subject to their respective terms of service and privacy policies.
10. Disclaimers
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. REALTORFINDER DOES NOT WARRANT THAT:
- The Platform will be uninterrupted, error-free, or secure
- Results obtained from using the Platform will be accurate or reliable
- Any realtor accessed through the Platform will meet your expectations or perform successfully
- Listings, proposals, or user-submitted content are accurate or complete
REALTORFINDER IS NOT A LICENSED REAL ESTATE BROKER AND DOES NOT PROVIDE REAL ESTATE BROKERAGE SERVICES. THE PLATFORM IS A TECHNOLOGY MARKETPLACE ONLY.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, REALTORFINDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL REALTORFINDER'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO REALTORFINDER IN THE TWELVE MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
12. Indemnification
You agree to indemnify, defend, and hold harmless RealtorFinder, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.
Informal Resolution: Before initiating any formal dispute, you agree to contact us at legal@realtorfinder.net and give us 30 days to attempt to resolve the dispute informally.
Binding Arbitration: If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform (including questions of arbitrability) shall be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA) Consumer Arbitration Rules, as modified by these Terms. The arbitration shall be conducted in Massachusetts or, at your election, via videoconference. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Judgment on any award rendered by the arbitrator may be entered in any court having jurisdiction.
Exceptions to Arbitration: Either party may bring an individual action in small claims court. Either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.
Class Action Waiver: YOU AND REALTORFINDER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Unless both you and RealtorFinder agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any class or representative proceeding.
Jury Trial Waiver: BY AGREEING TO THESE TERMS, YOU AND REALTORFINDER EACH WAIVE THE RIGHT TO A JURY TRIAL TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
If the class action waiver is found unenforceable for any claim, then that claim shall be litigated in the state or federal courts located in Massachusetts, and you consent to personal jurisdiction there.
13a. Entire Agreement; Severability
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and RealtorFinder with respect to the Platform and supersede all prior agreements and understandings. If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date and, where appropriate, by sending an email notification. Your continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
15. Termination
We may terminate or suspend your account and access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will immediately cease.
